Terms of use

These terms set the rules between you and DealJE, and between the people who use the app. By creating your account you accept them, along with the privacy policy.

DealJE is used in French. If this English translation and the French version ever differ, the French version applies.

1. Who runs DealJE

DealJE is run by Daniel Laera, Geneva, Switzerland — a private individual, not a company. Contact: contact@dealje.cloud.

2. What DealJE does, and what it doesn't

DealJE is a local classifieds app. It lets you publish a listing with a meeting point, find listings near you, and talk to the seller about them.

DealJE is an intermediary only:

• it neither sells nor buys anything, and is never a party to a sale — the sale is made directly between buyer and seller;
• it handles no payments. The payment method shown on a listing (cash, TWINT) is information from the seller; the money changes hands at the meeting, without DealJE;
• it offers no shipping, no delivery and no guarantee;
• it does not verify items, listings or users' identities. The only check is on your phone number, through an SMS code when you sign in.

So it is up to you to inspect the item before paying, and to refuse anyone who asks you to ship it or to pay in advance.

3. Your account

• You must be at least 18 years old to use DealJE.
• Your account is tied to your phone number. The details you give at signup (first name, last name, email) must be accurate.
• An account is personal. You are responsible for what is done from your phone, and you let us know if you think someone else has access to it.
• You choose your public name. It must not impersonate anyone else or be offensive.

4. Free of charge

DealJE is free: publishing, searching and writing to a seller cost nothing, with no limit on messages. We reserve the right to introduce paid features later. If that happens, you will be told in advance as described in section 13, paid features will be clearly marked as such, and nothing you did before they were introduced will be charged.

5. Publishing a listing

A listing describes a real item that you are entitled to sell and can hand over in person at the meeting point shown. The title, description, price, condition and photos must match the item.

The app itself enforces the following rules:

• Photos: up to 3 per listing, in JPEG, PNG or WebP format, 5 MB at most each.
• Expiry: an active listing automatically becomes "expired" 60 days after it was published.
• Bumping: an active listing can be moved back to the top of the feed, at most once every 48 hours.
• Editing: an active, paused or expired listing can be edited. Once marked as sold it can no longer be changed, because it serves as the record of what was agreed.
• A new conversation can only be started on an active listing. A conversation already under way stays usable.

Mark your listing as sold, pause it or delete it as soon as the item is no longer available.

6. What is prohibited

You may not offer on DealJE:

• weapons, ammunition and weapon accessories;
• drugs, narcotics and anything used to consume or produce them;
• medicines, whether prescription or not;
• counterfeits and unauthorised copies;
• stolen goods or goods of doubtful origin;
• adult content;
• live animals;
• and, generally, anything whose sale, possession or advertising is illegal in Switzerland.

It is also prohibited, in listings and in messages alike:

• to defraud or attempt to defraud anyone, in particular by asking for advance payment or for shipping by post;
• to harass, threaten or insult anyone;
• to send spam, advertising, or links unrelated to a listing;
• to publish someone else's content (photos, text) without their consent, or a third party's personal data;
• to circumvent the app's limits or disrupt its operation.

7. Offers

In a conversation, the buyer can propose a price, which the seller accepts, declines or counters. An unanswered offer expires after 48 hours. Accepting an offer settles a price between the two of you in the conversation, nothing more: it does not reserve the item, does not change the listing and commits no payment. The sale is made at the meeting. Offers are private: only the two people in the conversation see them.

8. Reviews

Once a listing is marked as sold, the person who wrote to the seller about it can leave the seller a review — once per listing. A review must be about the transaction and stay factual and respectful. Reviews are public, signed with their author's public name.

9. Reports, blocking and moderation

• Report: from a listing or a conversation, you can report someone by choosing a reason (spam, scam, harassment, inappropriate content, other) and adding details if you wish. The reported person is not notified.
• Block: blocking someone hides their listings from you and yours from them, hides your conversations and prevents any message between you. You can unblock at any time from your profile.
• Review: reports are read by the operator. There is no automated moderation: nothing is removed or blocked by an algorithm.

DealJE reserves the right to remove a listing, or close an account, that breaches these terms or the law, and to keep the information needed to answer a request from an authority.

10. Your content

Your listings, photos, messages and reviews remain yours. So that DealJE can work, you grant it a free, non-exclusive licence to host, reproduce, technically adapt (for example resize a photo) and display them to other users, solely to operate the service.

This licence ends when you delete the content or your account, except for what stays visible to others after deletion — your messages in their conversations and the reviews you wrote, anonymised, as the privacy policy explains.

You warrant that you have the right to publish what you publish, photos in particular.

11. Liability

Each user is responsible for their listings, their messages and the sales they make. As DealJE is not a party to sales, it is not liable for the condition, conformity or legality of items, for users' behaviour, or for a payment or meeting that goes wrong.

DealJE is a free service run by an individual. It is provided as is, with no guarantee of continuous availability: it may be interrupted for maintenance, change, or stop. To the extent permitted by law, DealJE is not liable for damage arising from its use, except in the case of intent or gross negligence.

12. Deleting your account

You can delete your account at any time from your profile. Deletion is immediate and irreversible. What is erased and what is kept in anonymised form is detailed in the privacy policy, section 7.

13. Changes to these terms

These terms may evolve with the app. Each version is published on this page, with its update date.

For a significant change — one that alters your rights or obligations, or introduces a paid feature — you will be notified at least 30 days before it takes effect, by email to your account's address and in the app. If you do not agree, you can delete your account before that date; continuing to use the app afterwards counts as acceptance.

14. Governing law and jurisdiction

These terms are governed by Swiss law. The courts of Geneva have jurisdiction, subject to any mandatory jurisdiction provided by law, in particular rules protecting consumers.
